If it is verifiable that the participation has nothing to do with
the employer (e.g. because the employer's areas of commercial
activities are totally unrelated to the Working-Group's subject
matter), I agree that in that case there will be no need to impose
a requirement for the employer to execute a patent non-assertion
covenant.

However, how can you verify that someone's participation has nothing
to do with their employer without knowing who the employer is?

In the present economic environment it is unfortunately not possible
to assume (without insisting on verifiability of all important
assertions) that people are telling the truth.
